By downloading or using the Novaq mobile app or accessing our website (novq.app), you agree to these Terms of Service.

If you do not agree to these terms, please do not use our services.
1.Overview
Novaq provides tools to help families and caregivers monitor health data, set reminders, and stay connected with elderly users.
These Terms apply to all users — including elders, caregivers, and family dashboard users.
2.Eligibility
To use Novaq, you must meet the following criteria:
- —You must be at least 18 years of age to use Novaq. No exceptions.
- —Novaq is strictly prohibited for individuals under the age of 18. There is no parental or guardian consent option.
- —If we discover that a user is under 18, their account will be terminated immediately and all associated data will be deleted.
- —You agree that all information you provide is accurate and up to date.
3.Accounts and Access
When you sign up, you provide an email (for the elder account) and create a unique username (for family dashboard access).
- —Keep your login details confidential. You're responsible for any activity under your account.
- —You agree not to share your login credentials publicly or impersonate someone else.
4.Service Plan
Novaq is completely free for all individual users and their families/caregivers. There are no paid tiers, subscriptions, or feature gates.

5.Data Collection and Privacy
Novaq collects only data necessary to provide its services — such as activity data, reminders, or SOS alerts.

- —By using Novaq, you consent to data storage and processing for health tracking.

6.Use of the Service
You agree to use Novaq only for lawful purposes. You must not:
- —Misuse or attempt to hack Novaq's systems.
- —Use Novaq to spread false information.
- —Access another person's account without permission.
- —Use Novaq for medical emergencies (Novaq is not a replacement for emergency services).
7.Medical & Health Disclaimer
CRITICAL NOTICE — NOT MEDICAL ADVICE
Novaq is a digital wellness and caregiving coordination platform. It is NOT a medical device, healthcare provider, licensed medical professional, or diagnostic tool.
By using Novaq, you expressly acknowledge and agree that:
- —All health data, wellness insights, AI-generated suggestions, and informational content provided through Novaq are for GENERAL INFORMATIONAL PURPOSES ONLY.
- —Nothing in Novaq constitutes medical advice, diagnosis, treatment, or a substitute for professional medical judgment.
- —You must ALWAYS seek the advice of a qualified physician or healthcare provider with any questions regarding a medical condition.
- —You must NEVER disregard professional medical advice or delay seeking it because of something you read, viewed, or received through Novaq.
- —Novaq does not guarantee the accuracy, completeness, or reliability of any health-related information displayed within the application.
- —Novq LTD, its officers, directors, employees, agents, affiliates, and licensors shall bear NO LIABILITY for any harm, injury, death, loss, or damage arising from your reliance on information provided by Novaq.
Emergency Warning: If you or someone you know is experiencing a medical emergency, call your local emergency services immediately. Do not rely on Novaq for emergency response.
8.AI & Third-Party Disclaimer
AI-Powered Features
Novaq includes AI-powered features (Nova Assistant, Nova Desk) powered by Google Gemini. By using these features, you acknowledge that:
- —AI outputs are informational only — not medical advice, diagnosis, or treatment.
- —AI responses may be incomplete, inaccurate, or outdated.
- —You should not rely solely on AI outputs for health or safety decisions.
- —AI conversation data is stored to improve your experience but is not used to train AI models.
9.Third-Party Services
Novaq integrates with third-party services to deliver its functionality, including:
- —Supabase — Backend infrastructure and database
- —Google Gemini API — AI-powered features
- —Twilio — SMS notifications for emergency alerts
- —Vercel Analytics — Website performance monitoring
- —Microsoft Outlook — Email communications
Novaq is not responsible for the availability, accuracy, or data practices of third-party services. Their use is governed by their own terms and policies.
10.Intellectual Property
All designs, logos, features, and content in Novaq are owned by Novq LTD.
You may not copy, resell, or modify them without written permission.
11.Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms.
- Abuse system access.
- Engage in fraudulent activity.
You may also delete your account at any time from your settings.
12.Limitation of Liability
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Novq LTD, ITS DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, OR PERSONAL INJURY ARISING OUT OF THE USE OF THE APP.
THE CAP
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF:
- —The total amount paid by you to Novq LTD in the six (6) months prior to the claim; or
- —The sum of ₦5,000 (Five Thousand Naira).
SOLE REMEDY: YOU AGREE THAT IF YOU HAVE NOT PAID Novq LTD ANY AMOUNTS DURING THIS PERIOD, YOUR SOLE REMEDY SHALL BE TO CEASE USING THE APP AND DELETE IT FROM YOUR DEVICE.
13.Indemnification
You agree to defend, indemnify, and hold harmless Novq LTD and its guardian/directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- —Your use of and access to the App
- —Your violation of any term of these Terms and Conditions
- —Your violation of any third-party right, including without limitation any privacy or intellectual property right
- —Any claim that your use of the App caused damage to a third party
Survival: This defense and indemnification obligation will survive these Terms and your use of the App.
14.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law provisions.
Any legal action not subject to arbitration (as set forth in Section 15 below) shall be brought exclusively in the courts located in Lagos State, Nigeria.
15.Dispute Resolution; Binding Arbitration
PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS
Any dispute, controversy, or claim arising out of or relating to this App, including its formation, interpretation, or breach, shall be referred to and finally resolved by binding arbitration. You and Novq LTD agree to waive any right to a trial by jury or to participate in a class-action lawsuit.
15.1 Arbitration Terms
- —The Venue: The arbitration shall take place in Lagos, Nigeria (unless otherwise agreed).
- —The Rules: The arbitration will be conducted under the rules of the Lagos Chamber of Commerce International Arbitration Centre (LACIAC) and/or the Arbitration and Conciliation Act.
- —The Language: The language of the arbitration shall be English.
- —The Decision: The arbitrator's award shall be final and binding on both parties, and judgment on the award may be entered in any court having jurisdiction.
15.2 CLASS ACTION WAIVER
You and Novq LTD agree that any arbitration or legal proceeding shall be conducted solely on an individual basis and NOT as a class action, collective action, representative action, or private attorney general action.
You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Novq LTD. If this waiver is found unenforceable, the entire arbitration agreement shall be void, and disputes shall be resolved exclusively in the courts specified in Section 14.
15.3 Exceptions to Arbitration
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or data security.
16.Changes to the Terms
We may update these Terms occasionally to reflect new features or laws.
Updates will be posted here, and continued use of Novaq means you accept the new Terms.
